Agreement to these terms
These Terms of Service ("Terms") apply to your use of dyadgrow.com (the "Site"), which is run by DYAD Marketects, a branding and marketing studio based in Albuquerque, New Mexico, founded by Vincent King. When these Terms say "we," "us" or "our," they mean DYAD Marketects. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
What the site is for
The Site shares information about our services, including branding and logo design, web design and development, video and photo production, and social media and content marketing, and lets you contact us about a project. Information on the Site is general and for informational purposes. It isn't an offer, a quote or a guarantee of any specific result.
Working with us
Client projects are governed by a separate written proposal, statement of work or agreement that we both approve before work begins. That document sets out the scope, timeline, fees, payment schedule, deposits, number of revisions, cancellation and refund terms, and when ownership of final deliverables transfers to you. If anything in that agreement conflicts with these Terms, the project agreement controls for that project.
Sending a message through the Site doesn't create a client relationship or obligate either of us to start a project.

Using the site
You're welcome to browse, read and share links to the Site. Please don't:
- Use the Site in a way that breaks any law or harms anyone.
- Try to disrupt, overload, hack or gain unauthorized access to the Site or the services that run it.
- Send spam, malicious code, or false or misleading information through the contact form.
- Copy, scrape or republish the Site's content without our written permission.
- Use the Site's content to train AI models or build datasets without our written permission.
Access to the site
We may restrict or block access to the Site, or ignore submissions, if these Terms are misused.
Our content and brand
The Site's design, text, graphics, videos, photos, logos and the DYAD Marketects name and marks belong to DYAD Marketects or are used with permission. They're protected by copyright, trademark and other laws. You may not use our name, logo or content to suggest a partnership or endorsement without our written permission.
Client work, logos and reviews
Portfolio pieces, partner logos and client reviews appear on the Site to show our experience. Client names, logos and trademarks belong to their respective owners, and showing them doesn't mean those organizations endorse anything beyond the work described. Reviews are shared by real clients and reflect their individual experiences. Results vary from project to project.
Copyright concerns
If you believe something on the Site infringes your copyright, email dyadmarketects@gmail.com with a description of the work, where it appears on the Site, and your contact details, and we'll review it promptly.
Contact form submissions
When you contact us, you agree that the information you send is accurate and that you're allowed to share it. Please don't send confidential information through the form until we've agreed on how it will be handled. How we treat what you send is explained in our Privacy Policy.
Links to other sites
The Site links to other websites, such as client sites, social media profiles and our Google Business Profile. We don't control those sites and aren't responsible for their content, policies or availability.
No warranties
We work to keep the Site accurate and available, but it's provided "as is" and "as available." To the fullest extent the law allows, we don't promise that the Site will be error-free, uninterrupted or free of harmful components, or that its information is always complete or current.
Limitation of liability
To the fullest extent the law allows, DYAD Marketects won't be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or business, that result from your use of, or inability to use, the Site. This section covers use of the Site only. Liability for client projects is set out in the project agreement.
Indemnification
If you misuse the Site or break these Terms and that leads to a claim against us, you agree to cover the reasonable costs of that claim, including reasonable attorney's fees.
Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law rules. Any dispute about the Site will be handled in the state or federal courts located in Bernalillo County, New Mexico. Before filing anything, we ask that you email us first so we can try to resolve it directly and in good faith.
Changes to these terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page. Continuing to use the Site after an update means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement about your use of the Site; any project is governed by its own written agreement.
